I, the Artist, retain, solely and exclusively, all the copyrights and rights to the original artwork. I grant the Customer a limited, nonexclusive, non-transferable, non-sublicensable right to reproduce images of the work for non-commercial purposes, as long as the work is credited to me (either by tagging my social media accounts - e.g., Facebook or Instagram - or by explicitly stating my name: “Melissa Wang”). The Customer may not reproduce, print, or otherwise redistribute the artwork, unless it is for purely personal and non-commercial purposes, such as sharing a photograph of the space displaying the artwork on social media, with the proper credit.
The Customer may not allow any modification(s) to the work during my lifetime without my written permission. If anyone modifies the work during my lifetime without my written permission, the work will no longer be attributable to me and the Customer must pay for restoration by a restorer whom I approve of.
I do not waive my rights under the Visual Artists Rights Act. Buyer may not allow any damage to the work. If the work is damaged during my lifetime, the Customer must pay for restoration by a restorer whom I approve; otherwise, it will no longer be attributable to me.
If it is determined that Customer is not taking proper stewardship of the artwork due to damage or modification without the permission of the Artist, the Artist may request the return of the artwork and the Customer will not be entitled to any payment or refund.
The Customer must inform me in writing if they plan to regift or resell this work to another individual, entity or organization (this is for archival purposes) and receive express written permission to make such a transition in ownership. The Customer must also provide me, the Artist, with the option to buy back the painting at the maximum price specified in this invoice prior to any gift or re-sell. If the artwork is being re-gifted or resold to an immediate family member of the Customer, there is no need to provide me with the buy back option.
Should the Artist have to pursue recovery or restoration of the artwork for any breach of these terms, the Customer will be personally liable for any costs, expenses and fees thereof.
With the completion of payment and delivery of work, the Customer agrees to the terms above.
